1.1 King Furniture Australia Pty Ltd (ACN 002 757 333) (“King Living”, “us”, “we” or “our”) recognises the importance of your privacy and takes care to protect your information.
1.2 Where we collect personal information and credit-related information from you or about you, we comply with the Australian Privacy Principles, the Credit Reporting Regime and the Credit Reporting Privacy Code as contained in the Privacy Act 1988 (Cth) (Privacy Act).
1.3 By visiting or using our website at www.kingliving.com.au (Website), contacting us or otherwise providing us with information (including, but not limited to, in person, in hard copy or online) you acknowledge that you understand and agree to the collection, storage, usage and disclosure of your information by us in manner described in this privacy policy.
1.4 Please note, to the extent our Website contains links to other websites which are provided for your convenience, we are only responsible for the privacy practices and security of our Website. We recommend that you check the privacy and security policies and procedures of each and every other website or application that you visit or use.
2. PURPOSE FOR COLLECTING PERSONAL INFORMATION
2.1 King Living primarily collects, holds, uses and discloses your personal information to provide our goods and services to you or your organisation or for our business purposes including, for example:
(a) to provide the best quality products and services to you;
(b) to promote our products and services;
(c) to undertake any warranty claims relating to our products;
(d) to communicate with you;
(e) to generally improve our business;
(f) for record keeping purposes;
(g) to improve the quality of our service;
(h) for market research;
(i) to track activity on our Website;
(j) to provide you with information about our business and services, including marketing or promotional material; and
(k) to conduct our business and provide customer support.
3. COLLECTION AND USE OF PERSONAL INFORMATION
3.1 In order to provide you with products and services, we collect personal information about you including from our Website, telephone conversations, e-mails and written and verbal communications.
3.2 We usually collect personal information directly from you. You may provide those details when you make an enquiry with us by phone or email, in person, when you complete a form on the Website, when you interact with our social media pages or when you engage with us to provide you with our services. We may collect information when you contact us by any means.
3.3 Some of the information we collect is “Personally Identifiable Information” which relates to you personally (“Personal Information”). Personal Information we collect can include, for example, your:

(b) contact details (such as telephone number and email address);

3.4 We may collect sensitive information from you or about you where there is a legal requirement to do so, or where we are otherwise permitted by law. In all other situations, we will specifically seek your consent.

4. DISCLOSURE OF PERSONAL INFORMATION
4.1 In order to provide our services to you, we may need to appoint other organisations to carry out some activities on our behalf.
4.2 All third parties are given access to the information they need to perform their function but cannot use that information for other purposes.
4.3 We may disclose personal information about you to;
(a) other organisations that we have affiliations with;
(b) promoters or sponsors of any competition conducted or promoted by us;
(c) specific third parties that you have authorised to receive information held by us;
(d) other third parties where necessary or desirable to provide you with our services;
(e) our employees, related bodies corporate, contractors or external service providers for the operation of our website or business, fulfilling requests or responding to enquiries from you or providing services to you including, without limitation, web hosting providers, IT systems administrators, mailing houses, data entry service providers, electronic network administrators and professional advisors and consultants;
(f) any relevant authority or enforcement body where we reasonably believe that such disclosure is necessary to bring legal action against anyone who has breached our terms and conditions or have engaged in any unlawful activity;
(g) such entities that we propose to merge with or be acquired by; and
(h) any other person where otherwise required or permitted to by any law, including under the Privacy Act.
4.4 Sensitive information will only be used and disclosed for the purpose for which it was collected by us or for a directly related secondary purpose.
5. SPECIAL CONDITIONS FOR COLLECTION AND USE OF PERSONAL INFORMATION FOR DELIVERY ARRANGEMENTS
5.1 The following terms apply specifically where you place an order with us. In providing any of the personal information of a third person to us in accordance with this section, you confirm and acknowledge that you have received the consent of each person for whom you have provided details and that such person consents to being contacted by us for the purposes listed in this section.
5.2 When you place an order with us, you will provide the full name and contact details of the persons you nominate to have “Full Access” to your order, these are:
(a) the “Primary Contact” for the order;
(b) the “Secondary Contact” for the order, who we will contact if your Primary Contact is unable to be contacted; and
(c) any further persons who you nominate to have Full Access to your order.
5.3 A person who has “Full Access” to your order is entitled to:
(a) obtain information from us about the number, types and colours of products comprising your order, and about the price of your order;
(b) obtain information from us regarding the date, time and location for delivery of your order; and
(c) arrange for the date, time and/or location for delivery to be changed.
5.4 A person who is nominated as the Secondary Contact or another person nominated by you to have Full Access may provide us with the contact details of a further person who can be contacted to confirm the date, time and location for delivery of your order, if they will be unavailable to accept delivery, and this further person will be treated as a Delivery Contact.
5.5 When you place an order with us you may also provide the full name and contact details of a “Delivery Contact”. The Delivery Contact will only be contacted by us to confirm the date, time and location for delivery of your order. The Delivery Contact will not be provided with any of your Personal Information or any other information relating to your order, other than your name and order number, and cannot:
(a) request information from us relating to your order, other than the date, time and location for delivery;
(b) make any payments to King Living on your behalf;
(c) change any of the order details, including the products comprising the order; or
(d) change the date, time or location for delivery of your order.
5.6 If you are a designer, you may nominate either:
(a) the recipient of the order;
(b) a Secondary Contact; or
(c) further persons nominated by you, as a Delivery Contact and we will only contact them to confirm the date, time and location for delivery. We will not contact any of these persons without first obtaining your consent. Any recipient, Secondary Contact or further nominated person will not be:
(i) able to change the date, time and/or address for delivery, unless you first provide us with your consent;
(ii) able to change any other details of the order;
(iii) provided with any of your Personal Information; and
(iv) provided with any information about the order, such as the price or products, apart from the date, time and address for delivery.
5.7 If you are making your order through a corporate entity, we will obtain the details of your authorised officer to be your Primary Contact when you place your order.
5.8 For the purposes of this section of the Privacy Policy, only you or the person who has Full Access can update their own phone number. If the change is requested over the telephone, we have full discretion whether we will update the requested change.
6. COLLECTION AND USE OF CREDIT CARD INFORMATION
6.1 King Living does not collect any financial information. Please note that where you apply for financing of your King Living products, you will be directed to a third-party provider who will manage your financial information.
6.2 King Living takes no responsibility for your disclosure of financial information or management of such financial information.
6.3 As a part of your use of a credit card to make a purchase, King Living will collect credit card information as a part of the King Living purchase process. King Living may need to provide this information to a third party in order to process your payment.
6.4 Any third parties that are granted access to your credit card information will only be granted such access to the extent needed to perform their functions.
7. SECURITY OF INFORMATION
7.1 King Living the security of your personal information, credit information and credit eligibility information seriously.
7.2 We take a range of steps to ensure that this information is secure. These include:
(a) ensuring that the information we collect is stored in a secure environment and protected from unauthorised access, modification or disclosure;
(b) restricting access to your information to the employees, contractors and agents who require that information in order to provide you with our products or services;
(c) backing up the information on a secure server; and
(d) ensuring our staff receive regular training on privacy procedures.
8. DISCLOSURE TO OVERSEAS RECIPIENTS
8.1 Information that we collect may from time to time be stored, processed in or transferred between parties located in countries outside of Australia.
8.2 By accessing our website, you agree:
(a) to and authorise us giving your personal information, in accordance with this privacy policy, to a third party who is not in Australia or a third party who may transfer and store outside Australia your personal information (Overseas Recipient);
(b) that, while we will take reasonable steps to ensure that an Overseas Recipient does not breach the APPs, Overseas Recipients are not bound by the APPs and subclause 8.1 of the APPs does not apply to the disclosure of your personal information to an Overseas Recipient; and
(c) that, if an Overseas Recipient handles your information in breach of the APPs, you will not be able to seek redress under the Privacy Act.
9. CLICK STREAM DATA
9.1 Each time you visit our Website our server collects some anonymous information, known as clickstream data, including the type of browser and system you are using, the address of the website you have come from and move to after your visit, the date and time of your visit and your server's IP address.
9.2 King Living may collect this information for statistical purposes to find out how our Website is used and navigated, including the number of hits, the frequency and duration of visits, and most popular session times. We may use this information to evaluate and improve our Website performance.
10. COOKIES AND WEB USE TOOLS
10.1 To improve our business, King Living uses a variety of tracking technologies such as cookies to recognise you each time you visit our Website, as well as to track which pages are visited and what you look at on our Website.

12. ACCESS TO YOUR PERSONAL INFORMATION AND CREDIT INFORMATION
12.1 King Living acknowledges that you have a general right of access to Personal Information and credit card information concerning you and to have inaccurate information corrected. Please contact the Privacy Officer (using the details provided below) for these purposes and we will respond promptly to your request.
12.2 If access is refused to your Personal Information or credit card information, we will give you a notice explaining our decision to the extent practicable.
13. KING LIVING EMPLOYEES, CONTRACTORS AND POSITION APPLICANTS
13.1 Additional privacy terms may apply to King Living employees, contractors, service providers and job applicants. We confirm that those further terms will be set out in any employment or service contracts.
13.2 This Privacy Policy does not apply in relation to acts and practices of King Living which relate directly to employee records of present and former employees of King Living.
14. CHANGES TO THIS STATEMENT
14.1 We reserve our right to revise this Privacy Policy from time to time. We will publish all updates to our Privacy Policy on our Website without any notice to you. All updates become effective when published on our Website.

15.2 If you are concerned with the way King Living handled your Personal Information or credit card information, please contact the Privacy Officer. We will endeavour to contact you within 7 days of you making your complaint acknowledging receipt of your complaint. It is our policy to investigate and resolve all complaints (where practicable) within 30 days of receiving the complaint. Where it is a legal requirement to do so, then in the event we need more time to investigate and resolve your complaint, we will notify you as to the reasons why and seek your agreement to extend this 30 day period (if you do not agree, we may then not be able to resolve your complaint).
