1 INTRODUCTION

1.1 To the extent there is any inconsistency between these Terms and Conditions and any other reference to the Promotion, these Terms and Conditions will prevail. If you participate in this Promotion then you are deemed to have accepted and agreed to these Terms and Conditions. 

1.2 If you do not wish to participate in this Promotion, please advise our showroom staff at the time of your transaction.

1.3 This Win Back Your Purchase Promotional Lottery (Promotion) is conducted by King Furniture Australia Pty. Ltd (ABN 79 002 757 333) trading as King Living (King Living) of 123 Turrella Street, Turrella, NSW 2205 (the Promoter). The Promotion is comprised of four separate lottery competitions (games of chance), as described in further detail, below.

1.4 Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

2 How to Enter

2.1 The Promotion Period commences at 12.01am AEDT on Saturday, 8 February 2025 and ends at 11.59pm AEDT on Sunday 16th March 2025.

2.2 During the Promotion Period there will be four (4) separate competitions. Each Competition has a separate Eligibility Period.

2.3 To enter a Competition, customers must visit any showroom in Australia or the Australian website (https://www.kingliving.com.au/) during the Eligibility Period for that Competition and enter into a binding transaction to purchase a King Living product (Sales Order). The entry will go into the draw only for that specific Competition which matches to the Eligibility Period when the binding transaction occurred. In order to go into the draw for a Competition, the date of the Sales Order must be within the Eligibility Period for that specific Competition.

2.4 A customer may enter a Competition more than once by entering into more than one binding transaction during the Eligibility Period for that Competition.

2.5 An entry which is valid for one Competition will not be valid for another Competition.

2.6 A customer may enter more than one Competition during the Promotion Period by entering into a binding transaction during each Eligibility Period.

2.7 Entry is only open to Australian residents aged 18 years or over, however entry is not open to residents of any Australian state where a permit to run this Promotion is required and has not been granted.

2.8 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, at its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of the Promoter’s rights.

 

3 Prize

3.1 The winner of the each Competition will receive the value of their purchase (as shown on the winning Sales Order) up to a maximum of $5,000, in the form of a refund. For the avoidance of doubt:

  1. If the total value of the winner’s purchase (as shown on the winning Sales Order) equals or exceeds $5,000, the amount of $5,000 will be refunded, but the balance of the total order value, as shown on that Sales Order which exceeds $5,000 will not be refunded;
  2. If the total value of the winner’s purchase (as shown on the winning Sales Order) is less than $5,000, the total order value, as shown on that Sales Order, will be refunded and the remaining balance of the $5,000 prize value voided.

3.2 Total prize pool value for each separate Competition is $5,000 (or less if the value of the winner’s transaction is less than $5,000) including GST.

3.3 The prize is not transferable or exchangeable.

3.4 Only one (1) Sales Order will be randomly selected with respect to each Competition. To be eligible for a Competition, the Sales Order must have a date which is during the Eligibility Period for that Competition.

3.5 The draw for each Competition will take place at 5:00pm AEST on the date of the draw (as described in the Draw Date – clause 2.2 above). Each draw will be conducted by a responsible employee of the Promoter, on behalf of the Promoter. The first valid entry as drawn by the Promoter will be the winner of the prize for that Competition.

 

4 Winner

4.1 If there is a dispute as to the eligibility or identity of an entrant or the validity of an entry, the Promoter reserves the right, at its sole discretion, to determine the outcome of that dispute.

4.2 One (1) Sales Order will be randomly selected as the winning entry for each Competition. To be eligible for the draw for a Competition, the Sales Order must have a date which is during the Eligibility Period for that Competition. Only transactions which are dated (according to the date on the Sales Order) during the Eligibility Period for a Competition will go into the draw for that Competition.

4.3 The Promoter may draw additional reserve entries, and record them in order, in case of an invalid entry or ineligible entrant. If the prize remains unclaimed as at 5:00pm AEDT on the Wednesday immediately following the date of the draw, the prize will be awarded to the first valid reserve entry.

4.4 The winner will be notified via email/telephone (using the contact details provided in conjunction with the entrant’s Sales Order) on or before 10:00am AEDT on the Tuesday immediately following the date of the draw. The winners’ details (last names, first initials and postcodes) will be published on the King Living website within 30 days of the draw or redraw if applicable.

4.5 This Promotion is a game of chance.

4.6 The Promoter’s decision is final and no correspondence will be entered into.

4.7 The Promoter is not liable for a winner who cannot be contacted in accordance with these Terms and Conditions.

4.8 As a condition of accepting a prize, the winner must, if requested, sign any legal documentation in the form required by the Promoter in their absolute discretion, including but not limited to a legal release and indemnity form.

4.9 By entering the Promotion, entrants acknowledge and agree that, if they are a winner, their name and/or image may be featured on the King Living website and any other online platform (including social media platforms) solely in connection with the Promotion.

 

5 General

5.1 Instagram, Facebook and/or other social media platforms may be used to advertise or promote the Promotion. However, entrants acknowledge that the Promotion is in no way sponsored, endorsed, administered by, or associated with, those platforms.

5.2 If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, at its sole discretion, to the fullest extent permitted by law:

  1. to disqualify any entrant; or
  2. to modify, suspend, terminate or cancel the Promotion.

5.3 Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including for negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion including (without limitation) loss in connection with:

  1. theft, unauthorised access or third party interference;
  2. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter,
  3. any variation in prize value to that stated in these Terms and Conditions;
  4. any tax liability incurred by a winner or an entrant; or
  5. use of the prize.

5.4 The Promoter reserves its rights to recover damages or other compensation from any person who breaches these Terms.

5.5 To the maximum extent permitted by law, each entrant indemnifies, and must defend and hold harmless, the Promoter and each of their employees, servants, agents and contractors, from and against all losses arising from:

  1. a breach by the entrant of any of these Terms;
  2. any third party claim arising directly or indirectly from a breach by the entrant of any of these Terms;
  3. any negligent, wilful or otherwise wrongful act or omission of the entrant;
  4. any fraudulent or dishonest acts or omissions by the entrant; 
  5. any breach by the entrant of any applicable Laws; and
  6. any claim by any third party (including individuals, legal entities and governmental departments or agencies) arising directly or indirectly as a result of the entrant entering the Promotion.

5.6 These Terms are governed by the laws of the State of New South Wales.

5.6 All monetary amounts referred to in these Terms are in Australian dollars and are inclusive of GST.

 

6 Privacy

6.1 The Promoter collects personal information (PI) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.kingliving.com.au/privacy-policy/.

6.2 The Promoter may contact the entrant in the future with information about the Promoter, including special offers, market research or to provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages or any other form of emerging, digital or conventional communications channel whether existing now or in the future. By entering the Promotion, entrants acknowledge and agree that the Promoter may use their PI in the manner set out in this clause.
